Understanding your DUI
DUI (Driving under the influence) is a charge that drivers can be accused of if they are pulled over and are found to be “influenced” by alcohol or drugs. DUI charges are determined by a blood-to-alcohol ratio and concentration—Otherwise referred to as your BAC. Your BAC must be AT LEAST .08% to be charged with a DUI or DWI in the state of Illinois. These are determined through breathalyzer tests.
It is also possible for you to be arrested under suspicion of a DUI or DWI if you were to be pulled over and refused a breathalyzer test. Police personae will then use field sobriety tests to further exam the distinction if you had previously denied a breathalyzer test.
You can also be arrested for DUI/DWI if the THC concentration of your blood is over five nanograms or more within two hours of driving. Additionally, there can be criminal penalties that could apply if the BAC of you or the driver is above .16%, there was destruction of property, cause of bodily hard or someone within the vehicle is under the legal driving and or legal drinking age within the state of Illinois.
